Managing Attorney - Government

Under the guidance of VP, Associate General Counsel, Government, the Managing Attorney will assure best practices through providing strategic legal direction and effective development, training and oversight of staff and associate attorneys, summer law clerks, and administrative staff in delivering legal advisory services on emerging legal and business issues related to the tribal government and its business enterprises, including governance matters, gaming law, legislative, intergovernmental relations, Tribal Court infrastructure, and legal issues related to intramural governmental activities. The Managing Attorney’s responsibilities will include providing recommendations to minimize legal and financial exposure to the organization.

ESSENTIAL DUTIES AND RESPONSIBILITIES

1. Legislative and Policy Development
  • Assists in negotiation and drafting of intergovernmental and related transactional matters.
  • Analyzes , collaborates with Tribal leaders, Tribal Citizens, and departmental leaders in drafting of tribal laws, regulations, and policies.
  • Participates in state and national attorney work groups on matters related to federal Indian law issues, including legislative and litigation matters.
2. Legal Counsel and Advisory
  • Counsels all levels of management and managing staff and associate attorneys in diverse issues related to government and its business operations, including in the areas of education, cultural resources, tribal court infrastructure, intergovernmental relations, legislative, political, administrative rule-making, strategic philanthropy, physical security and safety, fire protection, emergency management, and governance issues, as well as advising on regulatory compliance matters.
  • Provides recommendations to the Governing Council, Tribal Council, and government boards and committees on the above areas as well as matters associated with minimizing legal/financial exposure of the Tribal government and its business enterprises.
  • Advises on proposed and existing legislation; participates in drafting proposed state and federal legislation.
3. Tribal Court and Judiciary Support
  • Provides support to Tribal Court and the Judiciary Board as needed.
  • Represents the Nation as needed in connection with the Indian Child Welfare Act.
4. Regulatory and Compliance
  • Assures best practices and timely updates to address emerging legal and business issues related to Tribal government and its business enterprises.
  • Advises the Board on wide array of governance and compliance issues.
  • Monitors tribal, federal, and state regulatory agency requirements and provides strategic recommendations.
5. Legal Support and Documentation
  • Provides legal support to Tribal Community-facing departments including Tribal Community Services and Tribal Family Services, as well as externally- facing departments including Strategic Philanthropy.
  • Provides legal support on political and crisis management matters.
  • May assist due diligence efforts, under the direction of an Associate General Counsel, in various transactions and analyzing strategic and tactical decisions with various departments and divisions.
  • Prepares legal documents related to Tribal entities including resolutions, by-laws, meeting minutes, and other organizational documents.
6. Performs other duties as assigned to support the efficient operation of the department.

SUPERVISORY RESPONSIBILITIES

Carries out supervisory responsibilities in accordance with the organization’s policies and applicable laws. Responsibilities include interviewing, hiring and training employees; planning, assigning reviewing and directing work; evaluating and appraising performance; rewarding and disciplining employees; addressing complaints and resolving problems. Makes hiring decisions and designs individual development plans with succession planning in mind for all key roles.

 EDUCATION, EXPERIENCE AND QUALIFICATIONS

  • Juris Doctorate from an American Bar Association accredited law school is required.
  • Minimum ten (10) years of legal work experience is required.
  • Prior leadership/management experience or equivalent is preferred.
  • Related, relevant, and/or direct experience may be considered in lieu of minimum educational requirements indicated above.

KNOWLEDGE, SKILLS AND ABILITIES (KSA)

  • Experience working with tribal government highly preferred.

REQUIRED LICENSES, CERTIFICATIONS AND REGISTRATIONS

  • At the discretion of the San Manuel Tribal Gaming Commission, you may be required to obtain and maintain a gaming license.
  • Must be a member in good standing of the California Bar.
  • Select One of the Following for Driving Responsibilities:
    • Driving Responsibilities: Role requires regular commuting between locations. A valid driver's license and vehicle insurance with minimum liability limits is required. Role will not operate or drive Tribe-owned vehicles or patron vehicles.

PHYSICAL REQUIREMENTS/ WORKING CONDITIONS – ENVIRONMENT

  • Primary work environment is in a climate-controlled office setting.
  • Work requires travel to attend meetings, trade shows, and conferences.
  • Incumbents may be required to work evening, weekend and holiday shifts.
  • Must be able to work in a fast-paced, high-demand environment.
  • Strength sufficient to exert up to 10 pounds of force occasionally and/or a negligible amount of force frequently or constantly to lift, carry, push, pull or otherwise move objects and/or move up to 40 pounds occasionally.
  • Sedentary work: involves sitting most of the time. Constantly operates a computer and otheroffice productivity machinery, such as a calculator, copy machine, and computer printer.
  • Physical activities that apply to the essential functions of the position are balancing, stooping, kneeling, crouching, reaching, pushing, pulling, lifting, grasping, talking, hearing, and repetitive motions.
  • Hearing sufficient to hear conversational levels in person, via videoconference and over the telephone.
  • Speech sufficient to make oneself heard and understood in person, in front of groups, in meetings, via videoconference and over the telephone.
  • Visual acuity that meets the requirements of the position: The worker is required to have close visual acuity to perform an activity such as preparing and analyzing data and figures; transcribing; viewing a computer terminal; expansive reading and visual inspection of employees, visitors or facility.
  • Mobility sufficient to safely move in an office environment, walk, stoop, bend and kneel, and enter, exit and operate a motor vehicle in the course of travel to promotional events, meetings, conferences, trade shows and San Manuel properties.
  • Endurance sufficient to sit, walk and stand for extended periods, and maintain efficiency throughout the entire work shift and during extended work hours.
  • The employee may be exposed to fumes or airborne particles including secondhand smoke.
